Case:
You are employed as a
Contractual Consultant
specializing in Digital
Investigation by a local school.
There have been recent issues of
potential misconduct by staff
members posting inappropriate
comments on social networking
sites, potentially bringing the
school into disrepute and/or
criminal conduct, although the
latter element has yet to be
substantiated. This issue has
been complicated by the
School’s BYOD Policy which
has been embraced by the vast majority of staff members, but has led to disputes over the
extent to which the school can intrude on the privacy of staff members. The Board of
Governors is clear however, in that if a device is used on school premises that it is subject to
the Schools Rules and Regulations concerning acceptable use.
The school wishes however for you to draft some clear and relevant guidelines concerning
the seizure and examination of a device should the Information Technology Manager suspect
contravention of its rules. The school is clear it needs to be acting legally and should it seek
to evidentially use any material against a staff member that the guidance should be robust
enough to stand scrutiny by an Employment Tribunal. The forthcoming General Data
Protection Rules have to be considered in addition.
