Urgent Finanzgericht Eilantrag Filing

Job ID: 39954071

Budget: €250 – €750 EUR

I am contacting you regarding an international exchange of information initiated by the French tax authorities towards Germany at the end of October 2025.
I recently learned that this request likely concerns both myself and my wife, who is a Chinese tax resident and has no tax connection whatsoever with France. I understand that the German authorities (BZSt) may contact german banks in relation to this.
I would like to request your urgent legal assistance to file a protective appeal (Eilantrag) before the competent Finanzgericht in order to suspend the transmission of any banking information to France until the legality of the request is reviewed.
Key points of the case:
I am a French citizen but have been a tax resident in China/HK since 2012, officially recognized non-resident of France for years 2022 – 2024.
My wife is a Chinese national and Chinese tax resident, married to me under a separation-of-property regime recognized by French civil law.
The French request therefore has no legal basis to include her accounts, as she has no fiscal nexus with France.
Furthermore, the request seems overly broad and disproportionate, as no specific suspicion of undeclared income has been established.
I can provide you with:
A copy of the French request ;
Certificates of Chinese tax residency (for myself and my wife);
Our french marriage certificate confirming separation of property.
Please let me know as soon as possible whether you can take the case and the documents you need from me to prepare the Eilantrag.
I can provide all materials immediately in electronic format.
