Someone to write a habeas corpus on an illegal sentence
Budget: $30 – $250 USD
So I recently learned that my friend in prison in Ca since 2005 was illegally sentenced under the 3-strikes law. He was given an initial strike on a misdemeanor case that happened 10 years prior to the current case.
Originally he was sentenced to 6 months county jail time. 10 years later, the judge said he should have received a strike on the prior and he imposed it on him during sentencing thus making him a second striker.
During his appeal the CA 4th App court sent him back to the Superior Court on the strike allegation to correct it. The original sentencing judge (Shari Kesslar) in L.A. Superior Court wrote a Minute Order telling the Orange County Superior Court Judge (Hayes) she did NOT give my friend a strike. Judge Hayes imposed the strike anyway. They gave him the same sentence as a second striker.
This all happened in 2009. We need to do a writ of habeas corpus on the illegal sentence. I need someone versed in sentencing law to look at his (ridiculous) sentence and come up with something giving him time-served and at minimum removing the life-terms. He did not kill anyone yet the judge gave him 3 consecutive life terms. My friend is black and was living in Orange County married to a Caucasian female - I guess they thought they had OJ again? I don't know. Can someone please help me?
