Dispute to DA application
Budget: $30 – $250 AUD
A good friend of mine has a neighbour proposing to develop their property, which is obstruct my friend's water views. I'd like to support them with a submission to council to dispute. See below. More info in the attached.

You may or may not know that there is a DA application for the property next door to us at 6 Ford St Greenwich. The current house on the property is heritage listed and the new owners have submitted plans to add a new double storey building with a pitched roof that is set to rob us of our viewing corridor to the water. Indeed, if the plans go ahead, we also stand to lose ambient views and the spacious feel that we now enjoy. We will essentially be boxed in and looking at a high wall instead of trees, boats, bay! To get an idea of what I'm talking about you may open the attached document and refer to figure 7. (Assured to take your breath away!)
As well as the bulk and scale of this building there are also non-compliances with the Local Development Control Plan (LDCP 2010).
Two major ones are:
1) the side setback (how far the blg is set back from the Eastern border adjoining our property). This is 1.010, and the control for double storey is 1.5m.
2) the terrace between the old and new blgs. This is 6.72m deep, considerably larger than the max control of 3.0m.
As well, a double garage below the terrace stretches the build further south, closing the viewing corridor.
The owners are quite determined to push this through without sacrificing their space or design. They have no wish in trying to understand how this would impact their neighbours who have lived here for twenty years and no desire in finding a compromise! The amendments we called for in our first submission still stand, with only tokenistic changes made. Last week we made our second and final submission and the matter is now with Council. It is expected that this DA will go to a Planning Panel on the 5th April (to be confirmed) after which a determination will be made. If the plan is approved, it will impact our space and the enjoyment of our property immensely.
This is where I have a favour to ask of you.
Our architect has recommended we get as many submissions as possible in opposition to the current plans. He said this has helped another case he's working on. The planning panel are very interested to see how many submissions are lodged; hence how many people are opposed to it! It does not matter if the people are from another council area. They can be from anywhere in Sydney.
So, we are asking you for your support please. Many of you have visited our home and may even have enjoyed some entertainment on the outdoor deck with expansive views across the water to Woolwich. You would know what this means to us! Those who have not been here before, are most welcome to come visit.
If you can spare ten minutes of your time to submit a brief letter to Lane Cove Council, preferably before the planning panel meeting on the 5th April, that would be greatly appreciated!
In your own words you can say that you've seen (or even reviewed) the plans for DA 157/2021 at 6 Ford St Greenwich and believe that Council should not support this application, especially because of the non-compliances. You may make reference to the scale and bulk of the extension, make reference to figure 7 of the View Assessment Report, the non-compliant side setback, the non-compliant terrace area, the pitched roof, the loss of views, loss of enjoyment for the neighbour at 4 Ford St. ... and anything else you think is relevant.
The key message is your opposition to the plans as they stand. That Council should not approve the plans.
It doesn't have to be long or detailed. Just a clear message of opposition!
