Cease and desist letter required due to blackmail by personal relative:

Made a demand
R v Hester whereby the demand remains in existence as a continuous demand until it has been withdrawn.

a. To still allow mother to still reside at property, perceiving this as an eviction when there is not such agreement.
b. To also allow all of her personal items to remain at the property when I do not wish for this to remain here even when reasonable time has been given for its removal.

Menaces
This means that there must be some high degree of coercion to force an individual to undertake a particular course of action. A threat to expose a secret – can constitute blackmail.

5 x menaces including going into the public domain but worst of all seeking advising housing associations as per industry I work within in perceiving not having mother at property as an eviction.

Unwarranted Demand
It is unwarranted unless the person making the demand believes in both:

a. That they had reasonable grounds for making the demand.
b. That the use of menaces is a proper means of reinforcing the demand.

Not possible as had made the threat to expose a secret i.e. perceived eviction of mother and her belongings when there has been no such agreement, to those that do not need to know and would have no interest in this but still detrimental.

With a view to make a gain or intent to cause a loss
Only gain and loss of money or other property.

Loss of career and damage to it therefore loss of earnings.
