I am being sued for a civil complaint filed against me by my HOA. They filed a lien for HOA dues that were in dispute. They would not settle or accept a payment plan and proceeded with the Foreclosure in 2019. However I had a business loan that I took out on the property in 2017, which clearly stated on the Note which I provided to the HOA "LOAN IS NOT TRANSFERABLE AND CANNOT BE ASSUMED" The lien of $250,000 was due and payable upon transfer of title on October 2019 the 2nd foreclosed on the HOA and took possession of property via Warranty Deed. The HOA in a attempt to extort money from me, filed a law suit to cancel the mortgage along with punitive. They claimed they were not aware of the 2nd mortgage and believed I added the 2nd mortgage illegally at time after they foreclosed. Even though public records show the recording dates and do not support their claim.
