Civil Law - Divisional Court - A response to motion to Quash my appeal/lift my stay of eviction. I have attached some of the documents. There is more information available - I believe I have done a lot of the writing already as far as the points made by respondent through my review requests and responses to my neighbours case of a similar matter. I will give whomever accepts the task full access to this folder I believe that the motion to quash is baseless, frivolous and vexatious - not my appeal, as respondent claims. The landlord failed to accommodate a code protected disability, depended on witness testimony from a fire marshal with a conflict of interest, who misrepresented the facts. i have filed a complaint and requested a new inspection from his chief, but I feel his testimony should not be allowed into the evidence as even without the conflict of interest, his actions are questionable and atypical of his position. His statements were the basis of most of the decision making - I was not allowed to point out this conflict of interest to the Landlord tenant board as it was new evidence but was significant to the material facts and my circumstances were not properly considered and every point made by the tribunal in their decision making process can be attributed to this as well as therefore the law was not applied correctly as the eviction should NOT have been allowed. New evidence was not allowed by the Landlord tenant board judge which would have verified I was not appropriately accommodated to undue hardship and that the offer was made and accepted after the eviction was already underway. The eviction was at the forefront of this never was accommodation or support a serious undertaking by the landlord therefore the N7 would have been considered void. .

A - For April 4 anytime or April 5 before 12pm I must submit all evidence and any cross motion - I simply would need any recommendations for evidence I may not have thought of and a cross motion and the document to file. If applicable.

B - For April 14 the factum in response to the motion(s) to quash and cross motion (if any) .
