My project involves researching specific case law in the state of Colorado as it relates to family law. I'm looking for case saw where a judge has used discretion to minimize child support due to noncustodial parent's income (in this case disabled) being substantial lower than custodial parent. Custodial parent's income is 76% higher than noncustodial parent's income and custodial parent is asking for $1,080 a month child support order which would increase discrepancy to 81% higher than non-custodial parents, resulting in noncustodial parent not being able to keep home. I'm looking for case law to include in response motion.
