It has lost the right to hear this case and has left Hirjis without a lawful remedy. The ICCPR covenants are being utilized by Hirjis in this case. Canada in 1976 gave the Human Rights Committee the power to look into individual complaints by ratifying or joining an Optional Protocol (for the ICCPR, CEDAW, CRPD, ICESCR, and CRC) or by making a statement under a specific article of the Convention (in the case of CERD, CAT, CED)
