Negotiations to ex with contract dispute

Job ID: 31242911

Budget: £36 – £0 GBP

Keeping it as short as I can, my ex partner moved out of our property in April due to the relationship not working. Our property is in joint names but we're unmarried and a seperation agreement was drawn up together and signed giving me a 60/40 split of the property. The reason we worked this out was due to me paying over 70% of the household costs (mortgage, bills etc) in this and our last two properties and my ex sending me a very small sum of money each month for food and dog care, as she rarely worked and didn't have that much money.

Being generous and trying to keep it amicable, I gave a 60/40 split my favour instead of a 70/30 split in the seperation agreement, it was also written in she would return the engagement ring.

Everything was meant to be amicable until her father decided to be greedy and wanted to see if his daughter could "take me to the cleaners" financially. It ended up with my ex partner and I both having non-Molestation orders on eachother and we can't speak to eachother directly. I believe her father was trying to originally get me on a domestic abuse charge to make his daughter look like the victim if this went to court, but the charge was promptly thrown out by the judge.

Now everything has settled down and nothing came of the charges, my ex partner wants to finally resolve being bought out of the property. This I thought would have gone smoothly, but the letters I now recieved from her solicitor are trying to pick holes in everything. For example the seperation agreement being signed, they are trying to claim duress to get this voided, the original £30,000 loan my father loaned us to enable us to move from a flat to a house and was drawn up, witnessed and signed is now under scrutiny, as well as the return of the engagement ring.

The 2 estate agents valuations that I got that were unbiased is also being disputed, as they believe the valuation is to low, they want 3 estate agents of only their choosing..

All I want is to be rid of her and for her to only receive what she deserves/paid into the property, not everything under the sun. This is roughly £20k, but I believe they are looking around £50k.

I have already put a couple replies together for both letters with the real facts and figures, but I would like your advise and input on them so I am not opening myself up to anything. I think it may also be best if the reply came from legal representation if this is something that can be done. To me it looks like they are wanting to come to an agreement and they suggested a mediation, but the letters are quite far from the facts that I need to clear that up and point out a few things before anything like that can happen. Again your advise and help would be great.

I've done a draft reply for both but it's not solicitor worthy yet not knowing the legal terms etc and coming from a solicitor, or higher, would look like I mean business.

I look forward to your quotes.
