NSW binding financial agreement
Budget: $250 – $750 AUD
I am looking for two experts in NSW binding financial agreements to help me satisfy the requirement in accordance with 90G of the Family Law Act 1975 for myself and my ex.
My ex and I have divorced and have an amicable settlement. All but the transfer of our single shared property into her sole name with her providing a new mortgage has already occurred.
In order to avoid Stamp Duty we need either Consent Orders; or a BFA that meets the requirements of 90D. That document exists.
Therefore, we each now require assistance to meet the needs of section 90G namely legal advice; and a certificate the legal advice has been given.
That is all; as the SOLE purpose is for the Financial Agreement to become a BINDING financial agreement as defined in section 90G so that it will satisfy the application for Stamp Duty exemption.
The FA itself is complete, and simple; and attached based upon a purchased template.
Therefore we require either two independent firms; or one who can manage both parties without conflict of interest.
We are 'ready to go' as my ex now has a pre-approved mortgage and we now want to get on with the transfer of property.
I want to stress: this is an amicable matter; and all we each require is the minimum process to satisfy the requirement of 90G.
