This is a money case. Illegal eviction plus IIED. I need someone to lookup case law and references for me as I am representing myself and she has hired a lawyer.
My rent was $100 per month for February, March and April. I gave the Defendant $300 in February paying my rent up until the end of April. There was no lease only a verbal agreement on rent amounts and month to month tenancy. On March 4 the Defendant informed me via text she would no longer be renting the space as of April and asked me to be out by the 4th of April. On March 6 she text me a notice to quit with the incorrect spelling of my name. On March 11 she text me another notice to quit with my name spelled correctly. On March 29 the Denver Sheriff placed a scheduled eviction notice on my room entrance and on April 4, they put all my belongings on the street. I was never served with the eviction papers, ,only the notice to quit.
In addition, The defendant and I discussed my health on many occasions where she expressed empathy. On February 13, 2019 the defendant intentionally instigated an argument between me and another roommate (her boyfriend). The defendant stood by and watched as her boyfriend provoked me into an altercation by calling me derogatory names regarding my gender and race.
After this incident Defendant continuously antagonized and harassed me to move out. I was in fear of my life but had no alternative as I was scheduled for surgery. I consulted an attorney and followed his advice. I contacted the police to set up wellness checks since I no longer felt safe. Lastly I informed the Defendant how to communicate with me from that point on. In retaliation, the Defendant completed a notice to quit and texted it to me minutes after I was recovering from surgery. My release from the hospital was delayed because of the action taken by the defendant.
The argument on February 13 and receiving the text on March 6 caused my blood pressure to rise dangerously high. I have CHF and can provide documentation and medical records.
I have no idea what caused animosity for me from the Defendant. As far as I was concerned there were no problems or tension between us. I was completely blindsided by the hostility.
I have copies and pics of all texts and receipts relevant to this case.
I did provide the court with my address but requested it remain anonymous for concerns of retaliation from the Defendant.
I am suing for $10,000 for illegal eviction and intentional infliction of emotional distress.
