I'm looking for someone to write a civil complaint pursuant to California State law for false imprisonment of a Disabled Dependent Adult who was held for 12 days on an alleged 5150. Upon reviewing her hospital records from her stay, no 5150 was implemented until the 6th day and no trial was ever held to extend to 12 days. Every civil and human right were violated. No procedures mandated under CWIC 5150 nor CAWIC 15600 were followed. Patient had no mental health diagnosis & was never evaluated by a PSYCHIATRIST. She was beaten repeatedly, sexually assaulted & contracted an infection from the sexual assult for which she was treated for 3 days with IV antibiotics. She was never informed of daid infection and has just been made aware via record review. She was never told of anti biotics and had heart attack in an allergic reaction. This woman is disabled by Lupus. The ER put her into respiratory failure & 5 days in ICU as a result of giving contraidicated medications. We believe the the ordeal with the botched 5150 and the 12 days of torture and false imprisonment was an intentional cover up by the Hospital to attempt to paint this woman as a mental health patient who was out of control.
She has never been diagnosed w/ any mental health issue & infact has an IQ of 170. As a resuly of the gross violations of mutiple laws & medical malpractice, she now has permanent damage to her brain, GI, muscles & respiratory system. However the worst injury
she suffers from is unspeakable trauma and PTSD. She now needs full time care, is unable to leavev the house, due to agoraphobia, espcially to see a Physician. Any MD's that are able to treat her in her home are not coveted by insurance & are extraordinarily expensive which
is not sustainable. I need the civil complaint to cite compelling cases, precedence, criminal actions of elder abuse ( Dependent Adult Abuse
same laws) and emphasize how every law regarding 5150 procedure was not followed.
