Asking as a home owner, regarding a home owners association in West Virginia. Does due process (14th Amendment US Constitution apply to private entity: home owners association? Was told by a board member at a public meeting "The United States Constitution does not apply to home owners association." This is in regard to proposed "Animal Control Rules" that include the HOA boards authority to remove any pet within the HOA. They include no standards for same or reference to due process. It is my impression that due process does apply and that the HOA would require a court order. I am a pet owner and am NOT involved in any issues, but feel this is a blatant overreach on behalf of HOA and hope to influence the HOA to include due process for homeowners that are alleged to be in nonconformance with covenants/rules.
