CONTEXT
My wife and I have been the subjects of a campaign of harassment by an adult family of five neighbours in an adjoining home.
The significant events commenced on the 12th August 2021. Behaviours include and are not limited to:
- verbal assault;
- defamation;
- trespass upon our property;
- dividing fence demolition;
- statements of intent and actual use of vehicles as weapons.
Multiple police visits have resulted in the police suggesting APVO’s be sought.
A recent and significant trespass and installation of physical screening (essentially a dividing fence) without permission, that we removed immediately. Upon our removal the neighbours sought the police to press criminal charges for ‘malicious damage’ to their property.
This situation has become untenable and we feel we have no choice but to sell our home and move.
The costs and damages are significant and we are considering legal action to claim compensation.

PURPOSE
The purpose of this project is to:
- provide us with information to determine if there is merit in the concept of legal action;
- inform us of the relevant statutes and case law that may apply;
- provide us with examples of precedents, both successful and unsuccessful, that would inform our assessment of the potential difficulties and likelihood of success or otherwise.

This information may assist us in scoping the range of options that we might discuss as we seek legal representation.

OUTCOME
Key elements of this project outcome should include:
- a written report, with;
- an executive summary;
- detailed sections aligned with the three aspects of the aforementioned ‘purpose’;
- suggestions on the potential nexts steps.

TIMEFRAME
Delivery by 14th July 2022.
