Legal Expert to Draft Motion to Remove to Federal Court
Budget: $250 – $750 USD
I am seeking an experienced lawyer who has attended an ABA accredited law school and is a member in good standing of a state bar.
The project involves the drafting of a Motion to Remove the case to Federal Court. In the alternative, a Motion to Change Venue for an Extraterritorial Trial(precedent of Pitcarin Islands on similar facts), lastly a Motion for other remedies, such as limiting how many people can attend the trial, and sequestering the jury. This involves a territory, not a state, so the argument has to be made that jury fairness is a fundamental right. Lastly, the lawyers have missed every deadline for illness or other extenuating circumstances so you will argue the deadline was missed because of that.
Requirements:
- US-based lawyer
- Graduated from an ABA accredited law school
- Member of a state bar and in good standing
Ideal candidate:
-Strong research and writing skills
- Demonstrated experience in drafting legal motions
- Familiarity with federal and state court procedures
- Strong legal writing skills
- Thorough understanding of bias and prejudice considerations in venue changes
Your ability to address the primary legal issue (a Criminal matter in this case) in a compelling way, will be crucial. Some of the groundwork has been laid, there are on point law review articles and the government has recently made similar arguments.
