Legal Advice for QLD Estate Dispute

My mother died intestate in Qld Australia.

My brother made a fraudulent claim against the estate.

I never made a claim as I was under the assumption that the administrator of the estate would investigate my brother’s claims and defend the intestate rules of a 50/50 division.

The administrator never did any investigation into my brother’s claim. The matter was set for mediation. At mediation the administrator accepted my brother’s story and agreed to transfer the entire estate to him based on 99% hearsay.

A hearing date was set to enact the agreement. I attended the hearing and opposed the agreement under section 49 part 2 of the successions act. The Judge postponed the matter for another hearing.

My current financial situation does not allow for me to engage council to handle the matter on my behalf.

My questions are…

• What are my options at this point in time?

• Am I able to file a claim against the estate in the QLD Supreme Court?

• If not what documents may I file to defend the matter?
