Virtual legal research to be conducted via Online databases and resources at your university law libraries, Library at State Courts
Specific areas of law or legal topics that the research should focus on:
A. JURISDICTION
Jurisdiction of Singapore High Court to hear an Originating Claim issued in Singapore against (1) 1st Defendant - a Company in registered in Labuan Malaysia under a written contract which refers to the Labuan Financial Services Act as governing law and (2) 2nd Defendant- natural person & Malaysian citizen ordinarily resident in Malaysia.
The contract was signed by both parties in Singapore. Claimant paid monies to Defendant in Singapore. Claimants are Singapore Citizens & PR who are ordinarily resident on Singapore.
B. LIFTING OF CORPORATE VEIL-PERSONAL LIABILITY OF DIRECTOR OF 1ST DEFENDANT COMPANY FOR BREACH OF TRUST BY 1st DEFENDANT COMPANY
Research Singapore case law and text books for cases where the corporate veil can be lifted and Director held personally liable of breach of trust by Defendant Company. Typically this has been done in cases where the Defendant company is a travel agency or other company holding customer's money on trust for customer and Defendant committed breach of trust and wrongly used or withheld customers money for Defendant's own benefit or use.
Must be able to give a concise summary of the available or applicable law with citations as well as copies of all cases, text book extracts etc.
