Failure to explain why the retainer for the OSC was not being honored.
The attorney told me it would take approximately two weeks to file an order to show cause.
Failure to return my phone calls necessitating me having to block my number so the office would answer .
The law firm held onto my retainer for 10 months ($7,500).
The law firm took no action regarding my case. The law firm never told me what attorney was writing the order to show cause. When I did connect with the law firm after blocking my number I was told it would be against the law to file any pleadings because of the moratorium that was in effect due to. The paralegals who claimed to be senior litigation attorneys, that were involved in my case obviously did not understand the facts of my case and that I was not the standard foreclosure case. The information on the paralegal provided was a lie. At the 12th hour I had to retain new counsel necessitating an emergency order to show cause to be filed. The order to show cause was properly filed and signed by the judge.
The the attorney I first spoke to was aware that my case was a wrongful foreclosure action on a mortgage procured by fraud. Documented in the 2015 US Federal agency investigation establishing identity theft and mortgage fraud. The law firm's failure to act put me in a terrible situation jeopardizing my home after being victimized by identity theft and fraud 48 hours before the auction of my home I retained new counsel. The new attorney read through the 1000 pages of documents and effectively filed an emergency order to show cause with the court. The judge signed the order to show cause. Council did not need 10 months to read thousands of pages of documentation to effectively file an emergency order to show cause . On the eve of the auction at 8 p.m. the sale was stopped. Now on should ever be put through what I was put through. Gross negligence and lies breaking a fiduciary duty.
