Breach of Contract Small Claim Filing
Budget: $30 – $250 USD
I need a professional to assist me in filing a small claim lawsuit due to a breach of contract. I have the necessary documentation to support my claim, including a written contract and email communication.
This issue started with having my ADA Rights and Civil Rights violated by a Hilton hotel. I have the legal justification for a federal claim but have past the statute of limitations because of trying to settle outside of court. My original demand letter was for $195k and I signed a contract at the last minute to settle for just $3k, which doesn't cover the $10k in legal fees I have already paid. The hotel has 7 days to pay me in September and to date hasn't. I received email confirmation that they were going to pay but they never did. I wrote a new demand letter informing them of my intent to file for $12,500 for breech of contract and emotional distress for the whole situation. I originally was denied access to PAY for an upgrade from a pet friendly room to a suite strictly because of my Psychiatric service dog, which is a violation of ADA Law. I offered to call the sheriff to explain the law to hotel staff and I was threatened with filing a FALSE police report and going to jail by making the statement saying "then I will press charges on you for trespassing if you want to go that route". This caused me to have a PTSD Panic Attack, which I requested an ambulance assistance for with the hotels customer service line. The effects of this pricipitating event on 9/15/22 caused me to go into a state of psychosis that lasted several months. Having them refuse to acknowledge the violation of my ADA Rights and take responsibility for the actions taken against me have caused me a lot of emotional distress. On 12/23/24 I got an email from their attorney saying that his client agreed to the terms of my new demand letter asking for $12,500 and vouchers for 14 free nights at the hotel. Unfortunately the lawyer is now claiming that was a misunderstanding and that he was referring to the terms of the contract I signed in September for only $3k. I want to know if I have a case for small claims that will favor me and get help filling out the paperwork and following the process to finally get closure for this traumatic event I experienced. Any help would be appreciated.
