Attorney to Draft Correspondence

Non-custodial parent residing in MD. I was convicted of 3 misdemeanors in VA in 2017 (false reporting to police/cps and contributing to the delinquency of a minor). Custody was given to my ex-husband who lives in Columbia, SC. Due to a protective order in VA , I have had no contact with my daughter, now 10 yrs, since 2017.

Upcoming custody trial in April in MD (who has held custody jurisdiction since 2017) attempting to retrieve my daughter’s medical records to schedule a deposition. The doctor office (on guidance from my ex-husband’s attorney in MD and my daughter’s therapist) has refused to provide the records.

To keep the records, my ex-husband requested and has been awarded a MD protection order for my daughter’s records on March 11th. The order has not been signed. The protection order does not prohibit me from receiving the records, it prevents disclosure of the records- securing confidentiality.

I am seeking an attorney to compose written correspondence that outlines South Carolina law (SC law Section 63-15-260, S.C. Code of Law) and HIPPA rules requesting that the records be remitted per law. The purpose is to follow-up to the attached.
