I need some legal assistance if you are able for my business.

I was served papers from a restaurant in Aspen, CO for an outstanding balance for a Dinner we hosted our last night there.

We verbally agreed upon $4,000 for 50 people which included a few bottles of wine and appetizers along with the entrees the owner selected to fit within the budget. We did not have a written agreement. I just told him my budget of $4,000 and he came up with the menu from there for 50 people.

I paid him $5,500.

At the end of the night, he claimed 89 people were there and we did not even have that many people in our party. I asked him for a ledger of what was ordered that night and he was not able to provide that nor provide what bottles of wine were consumed or opened. And he was extremely rude and upset and it was a complete shock. He just gave me a receipt with a $7K plus ticket

I told him to run my card for $4,000 and give me my card back so I can go because I was feeling embarrassed and very disrespected. (I had given him a $1500 deposit earlier that day). They ran out of food and many people did not eat, including myself, my husband, and the 2 VIP guests.

He refused to give me my card back after I consistently requested it and after feeling helpless. I left. He sent the police to our hotel and after talking to them they let me and my husband leave after having pleasant random conversations and telling us how to travel on the road back to Denver.

While I was gone, the restaurant owner charged my card that he refused to return for another $600. I have since reported and disputed this with my bank and had to cancel my card during traveling and order a new one.

I have to send an answer by the 19th and I just want to make sure I submit my answer the best way possible first in hopes this case is dismissed. They files the suit in my personal name and business name.
