Arguing the doctrine of judicial estoppel. Matters involve a dispute over ownership of property and a business. The research issue is that the opposing party filed for bankruptcy which was dismissed. Over the next couple of years, he acquired some real property and a business. He later moved to reopen his prior bankruptcy case filing another declaration that all pleading were accurate and complete. He did not amend his petition to include the real property and business he had acquired after the closing of the case but prior to reopening the case. Issue - did he have a duty to disclose his ownership in the real property and business when he filed to reopen his bankruptcy case.
