Commercial Lease Contract and Guarantors

I need NY laws on the following:
1. Should the Landlord prove that the Tenant owes late rent before reporting the Guarantor to the Credit Bureaus?
2. Is it okay for the Landlord to sue for all future rents on the entire Lease if the Tenant is less than one month late with the rent?
3. Is it considered constructive eviction if the Landlord cuts off phone services, discontinues the key card to enter the building, rejects Tenant's mail, and places Tenant's office furniture in storage?
