Australian False Advertising Law Research
Budget: $30 – $250 AUD
I’m preparing a research piece on misleading or deceptive conduct under Australian law, zeroing-in on false advertising disputes. I need a researcher who can mine AustLII, LexisNexis, Westlaw, ACCC publications and recent Federal Court judgments to give me a clear picture of where the law currently sits and where it is trending.
The work should cover:
• Statutory framework – especially Australian Consumer Law ss 18, 29 and any sector-specific regimes that regularly feature in false advertising claims.
• Leading and emerging cases over the past ten years, with concise case summaries highlighting the facts, findings and key reasoning on deception or misleading impressions.
• Common defences and how the courts have assessed them.
• Typical remedies ordered (injunctions, corrective advertising, pecuniary penalties, damages) and any notable variations.
• Practical insights from regulators’ guidance or enforcement actions that help illustrate the risk landscape.
