I'm looking for a legal expert who can provide advice relating to Tennessee real estate/timeshare law. I have specific questions and concerns and require general advice, but not assistance in drafting any documents. The ideal candidate should have knowledge related to this area of TN law and be able to provide professional advice.

I bought a timeshare in TN in 1982. For the first 15 years or so I actually used the timeshare by exchanging through RCI. Since that time I have only paid the maintenance fees.

I have moved out of state and have not kept up with what is going on at the timeshare, and the letters and notices I've received have been vague.

Because of a dramatic increase in the fees, from something like $450 to $699, plus a large assessment a couple of years ago, and also because I have more time on my hands now that my kids are grown, I have started paying attention and asking a few questions by phone.

I've just learned in May that 50% or more of the timeshare owners are not paying their fees. When I called earlier in the year, before paying my dues, I was told that something like 10% were not paying.

I also just learned that the Timeshare association converted one of the buildings to full-time rental units. This was not disclosed in any communications I have received before May of this year.

The Timeshare is part of a regular full-time property and HOA. The timeshare assoc. shares in the expenses of maintaining the facilities such as pools and golf course.

MY QUESTIONS ARE:
It just seems like a lot of shady things are going on here, and I would like to know what my rights are.

For instance, am I entitled to get a list of email addresses of the timeshare owners currently still paying? It's not large enough for a class action, but if others were interested in joining in any potential lawsuit or a simple demand to know what is going on, that would be more effective.

Am I entitled to know what legal action the Timeshare Association has taken against delinquent accounts? Does the Association have an obligation to pursue payment?

I would also like advice on the potential downside of not paying my dues next year.

I have some documents from the Register of Deeds in that County. I need to get a couple more before the full documentation is complete.
