The documents in question were originally bought by a joint group, that I was part of. Each member—including myself—paid an equal share. One of those members has since registered a limited company using the consortium’s name and has placed the jointly-funded documents on the market without the consent of the rest of us. At no point did we agree to transfer ownership or grant him exclusive selling rights.

I need both clear legal advice and full representation. No formal action has been started yet, so you will be steering the matter from the very first letter through to any court application that may follow. My immediate objective is to halt the sale—whether that involves a cease-and-desist letter, an injunction, or another effective remedy—and to affirm that the documents remain jointly owned.

An attempt has been made to ask him to cease via email, met with a blanket refusal.

You will be expected to:

• Assess the chain of title and any consortium or shareholder agreements that exist.
• Draft and dispatch the necessary pre-action correspondence to the individual and his new company.
• Prepare the paperwork for urgent relief if the documents continue to be marketed or sold.
• Advise me on longer-term strategies to safeguard my interest in future materials I am purchasing under my own new company.
