NCAT Lease Dispute Submission

I am preparing court submission to NCAT appeals over a commercial lease default. The tenant company has entered liquidation and the lease was backed by a personal guarantee. This matter was heard and judgement was made that the guarantor was not liable. We are seeking to reverse this judgement in an front of an appeal panel.

Your role is to review existing legal documents, arguments, find suitable case law and create submission. Familiarity with Australian commercial leasing law, the Conveyancing Act 1919 (NSW), Retail Leases Act, Corporations Act liquidation provisions and relevant case law is essential. I will provide all background and supporting documents and appeal panel submissions. What I need now is a sharp, well-reasoned submission that methodically sets out legal errors, liability, addresses any potential defences and cites authoritative precedents.
