I am writing to inquire about the examination of a handwritten signature on a Power of Attorney (POA) document executed in 2018.
At that time, my husband granted full Power of Attorney to his sister without my knowledge. I only recently became aware of this POA after my husband was admitted to the VA Hospital’s psychiatric ward in Albuquerque, New Mexico, due to symptoms consistent with dementia.
While the signature on the POA appears to resemble my husband’s handwriting, I am seeking a professional graphologist to determine my husband’s personality, possible health ailments, if he was under duress, and the authenticity of the signature itself—specifically, whether my husband knowingly and voluntarily signed the document.
For background, my husband sustained a head injury in the 1970s while serving in the military. Over time, he experienced recurring headaches, PTSD, and cognitive decline. When we met in 2011, he frequently complained of severe headaches. After later reviewing his military medical records, I learned of the head injury and its possible long-term effects. This has raised concerns about whether he may have been experiencing cognitive impairment or early signs of dementia at the time the POA was signed in 2018, and whether such findings could be relevant in a legal setting.
Currently, when I discuss the POA with my husband, he states that the document was fraudulent. His sister now holds temporary guardianship and conservatorship over him. We are scheduled to return to court on February 3, 2026, regarding permanent guardianship and conservatorship.
