Court Order Needed for a Tissue Block Sample -- 2

In 1985, a man was wrongly convicted for murdering his ex-wife. At first, the woman came up missing. Then, a decomposing body was found in a field, and was determined to be the victim. A tissue block sample was taken from the corpse, and the man was convicted of murdering her. He was sentenced to life in prison.
While serving his sentence, the man began to suspect that the found, decomposing corpse, may not be his ex-wife. So, he asked to have a DNA test performed on the tissue block sample that had been taken from the body. However, the medical examiner's office, which has custody of the sample, refused to allow the sample to be tested. So, the family exhumed the body, from the victim's grave, and performed a DNA test. That test revealed that the body, in that grave, does not match the victim.
Now, the family of the convicted man, is seeking to perform a DNA test on the tissue block sample, that was taken from the body that was found in the field. Unfortunately, the medical examiner's office won't release the sample without a court order.
