MPF Software contract breach
Budget: £250 – £750 GBP
I recently contracted with a third-party contractor to develop a marketplace software for my business. We entered into verbal and written agreements outlining the scope, budget, and timeline for the project. Unfortunately, shortly after initiating the project, I observed that there was no design stage. The supplier intended to simply grant me an instance of their existing platform. The problem is that the standard design goes contrary to consumer laws in the UK and most part of the world. It seems they knowingly build a non confirming application in a bid to get customers to pay more for customisation. After repeated attempts to come to a resolution, it has become clear that the contractor has breached our agreement.
At this point, I am looking for assistance in resolving the contract breach. Specifically, I am needing help to secure a refund of the $7,000 (USD) which I have paid. I understand the gravity of the situation and am looking for an experienced freelancer who can take on this project. In order to handle the case successfully, the freelancer should have some background in dispute resolution and contract law.
They claim their proposal states monies paid are non refundable but their proposal also states that there would be a design phase to determine suitability for their platform. This never happened. The proposal also does not require me to accept a solution that once operational would violate consumer laws.
