What? An unscrupulous electric company pulled a con game on thousands of people In my small Illinois town by sending everyone a scammy, intimidating and coercive letter. That "letter" was an "offer" to 'Opt out" of switching our electric company FROM the 118 year-old ComEd electric, TO the conman Dynegy electric services in Irvine, Texas. The way they went about that was that they included a CARD with that letter that the letter stated we MUST sign and RETURN that card BACK to Dynegy, or we would AUTOMATICALLY BE ENROLLED IN THAT SWITCH-OVER. Can you give me TWO pieces of case law that will exemplify to the judge that the proposed. contractee in a PROPOSED contract, doesn't have to do a damn thing in order to NOT become enrolled into a PROPOSED contract? it is important to remember here that THEY are the ones that this "offer" was entirely UM-solicited by me.
