Alberta Property Indemnity Clause Review
Budget: $250 – $750 CAD
I own a condo rental property in Alberta Canada. I'm evaluating property-management agreements which seem to grant overly broad indemnity to the property manager, precluding suit even in cases of negligence, wilful ignorance, or fraud! I need a lawyer or experienced contract specialist who knows the Alberta Residential Tenancies Act and related case law to:
• Analyse the current wording as it's presented in two separate potential contracts and explain, in plain language, the true extent of protection it offers.
• clarify for me whether these indemnities are enforceable, or even consequential in Alberta
• These clauses have appeared from more than one corporate property management house. Are they common place? Give me some perspective on whether this should be a deal breaker, or whether it's just a minor speed bump in case of a property manager's malfeasance.
• Cite relevant statutes or precedents so I can confirm your findings.
I'll share the proposed contracts once we're agreed. I'll require your narrow focus on the relevant clauses.
