H-1B Transfer Representation for Job Change

Job ID: 40251966

Budget: $250 – $750 USD

I am seeking experienced immigration counsel to handle an H-1B transfer in connection with a new software-engineering role I am considering accepting.

Background:
• EB-2 priority date: November 2021
• I-485 filed and receipted: November 2025
• Currently on H-1B status (cap-subject)
• Also approved for and holding a valid combo EAD + Advance Parole (since February 2026)
• I-485 has been pending more than 180 days

Although I am eligible to work on my EAD under AC21 portability, I prefer to explore maintaining or transferring H-1B status for status protection and long-term flexibility.

Scope of Representation Requested

I am looking for full legal handling of the H-1B transfer, including:
• Evaluation of eligibility and strategy (EAD vs H-1B transfer comparison)
• Preparation and filing of Form I-129 H-1B transfer petition
• LCA filing and compliance review
• Premium processing (if recommended)
• Assessment of AC21 portability implications
• Written confirmation of:
• Impact (if any) on my pending I-485
• Preservation of priority date
• Travel considerations while transfer is pending
• Risks under current USCIS adjudication trends

If AC21 portability alone is advisable instead of H-1B transfer, I would like a clear written explanation citing relevant statutory authority (INA §204(j)), USCIS policy manual guidance, and any recent adjudication considerations.

Specific Questions
1. Is maintaining H-1B status strategically safer than relying solely on EAD given my timeline?
2. Are there material risks to the pending I-485 if I change employers?
3. Does filing an H-1B transfer provide additional downside protection compared to AC21 portability alone?
4. Estimated attorney fees, USCIS filing fees, premium processing costs, and employer obligations.

Deliverables
• Concise written legal opinion
• Full preparation and filing of H-1B transfer (if proceeding)

Ideal Counsel
• Experienced with EB-2 to green card transition cases
• Familiar with AC21 portability and post-180-day I-485 employer changes
• Up-to-date on current USCIS adjudication climate

Please include:
• Total estimated legal fees
• Filing fee breakdown
• Expected processing timeline
• Similar cases handled recently
