Dear Performance Team,

Plan of Action below:

-- Greater detail on the root cause(s) of the infringement.

The root cause of the infringement is due to the design similarity of my products to that of Robostore & RSI Universal design. We were selling Mapout our own brand Diagnostic Tool Cable for Two-Wheeler KTM, Bajaj. Also, we were unaware of brands like Robostore & RSI Universal design which we have mistakenly mapped.
We had purchased it from our supplier as Generic products assuming that these are from the same brands. We have studied and found that:

1. This issue is related to mapping the product in Robostore & RSI Universal brands.
2. We purchased these from 2 vendors and we are attaching the purchase invoices here.
3. The design of the product is similar hence employee has mistakenly mapped into these brands directly.
4. Our team was unaware of these brands.
5. We had a lack of knowledge about the Robostore & RSI Universal brands.
6. We had a lack of knowledge about the Amazon intellectual property guidelines. (section 3 under the business agreement)
7. We have recognized our mistakes and are taking the necessary steps to resolve them.

-- Greater detail on the actions we have taken to resolve the infringement issues.

1. We immediately deleted all the mapped listings. We deleted listings for the ASINs:
B07L9JCRKL, B08W8BFVVG, B08W9W8K9Q. All ASINs were listed in MFN and hence no removal order was created.
2. We began reviewing all inventories for other areas that could be affected by the Intellectual Property guidelines, guidelines from amazon.
3. We are buying legally from our suppliers; all the invoices are attached here.
5. We have deleted these items from our catalog and no longer have any in stock to sell and will not map them going forward.
6. We have made our team aware of the Amazon policies and asked them to list under our brand name only.
7. We have hired third-party services from the month of April 2021. They have to check for infringement and trademark issues on all our listings on amazon so that we can identify them and delete them.
8. We have sent the retraction/apology email to RSI universal (attached here)

-- Greater detail on the steps we have taken to prevent infringement going forward.

1. We checked for other similar listings which may contain the same error and deleted similar listings which may cause the issue.
3. We have reviewed and retained a copy of the Amazon Brand Infringement Policy from https://sellercentral.amazon.in/gp/help/G202039430
4. We have set a process that prior to listing the product, the I & SPN team will review each listing and after clearing it only then live on the platform.
6. Also, there will be a physical check of all the listings before final packaging.
7. We have trained our teams about infringement policy violations.
8. SPN is helping us with amazon listing guidelines and approval processes before creating new listings.

-- Greater detail on why you believe an error has occurred.

1. This infringement happened in error – We were not aware that we were infringing on these brands.
2. We have deleted listings of all mapped listings of Robostore & RSI universal and other brands.
3. We have also gone through infringement policy - https://sellercentral.amazon.in/gp/help/G202039430
4. We have sent the retraction/apology email to RSI universal (attached here)
