I need a Tax Lawyer

Funds were taken by an employee (22,000 over 4 years) and he has paid half back but not in the financial years the funds were taken. My accountant states that I as CEO have to declare the missing funds as dividends when I didn’t take the money and can prove it and the employee has a repayment arrangement in place. The employee is also my son.
